Just a few days ago, a Jerusalem District Court judge sentenced an Arab man to jail time for a highly unusual crime. His wrongdoing was having consensual sex with a Jewish woman. This is because she claimed that she only had sex with him after he lied to her about his ethnicity. She says she was duped into the act and filed a rape charge against the Arab man.

Sabbar Kashur is a regular Arab man, he is 30, has two kids and a wife. However, now he has been sentenced to a staggering eighteen months in jail for his crime. Kashur posed as a single Jewish man who was looking for true and long-lasting love, and a possible relationship. He approached the woman, and they consequently had sexual relations. Shortly after the act, the woman found out his 'deception' and went to the police where she got them to charge Kashur with rape and indecent assault. After being taken in and questioned, Kashur agreed to a charge of rape by deception.

Judge Zvi Segal stated in his final verdict that if the woman had known he was not a single Jewish man she would not have agreed to have sex with him. Kashur, however, was defiant towards his ruling calling it an act of racism.

Years before, the Israeli High Court, set an example for the rape by deception charge. It had previously denied the appeal of a man convicted of a rape charge because he had impersonated a ministry official in order to sleep with women. This woman stated he promised to give them apartments as an exchange for the encounter. Kashur's lawyer called the ruling obscene, and the Israeli High Court had gone too far applying that precedent to similar events. This would cause every woman who had been told lies about someone's identify to file rape complaints against their regrettable but consensual sexual encounters.

Rape by deception has been used legitimately in several other countries, including several incidents in the United States. The Arab population in Israel is approximately 20% of the entire population.
